'Hell Hath No Fury Like a Wealthy Person Being Told No': Can Elite Shoppers Really Force Hermès to Sell Them Birkins?

Fashion and Luxury Goods attorney Danielle Garno commented on a recent lawsuit against the luxury brand Hermès in an article by The Guardian. Two Californians are accusing the company of blocking them from trying to purchase Birkin bags, alleging Hermès is practicing unlawful "tying" or influencing people to buy other products to prove they are worthy of buying a bag. Ms. Garno explained why she believes the lawsuit will be tough to win.

"[The plaintiffs would] have to prove that Hermès has sufficient economic power in the market with the Birkin and Kelly bags to essentially shut out competition in the market of the other ancillary products (belts, scarves, home goods, etc)," she explained.
