How Dynamex Decision Could Impact Contractor Classifications

Transpo Cos. Brace for Post-Dynamex Legal Onslaught
– Law360

Manatt’s Esra Hudson, chair of the firm’s employment and labor practice, was quoted by Law360 for an article on the California Supreme Court’s Dynamex decision.

The publication noted that the decision could have major implications for the standard that determines whether workers are employees or independent contractors.

“We’ll have to see how the industry responds,” Hudson said. “There may be legislative changes proposed to clarify whether certain types of professional transporters who own their heavy trucking equipment, for example, will be exempted from this factor. Until then, I would expect to see an uptick in class actions in this industry.”
