Higher ed webinar series provides insider’s look at borrower defense rulemaking

As one of the primary negotiators tasked with reworking the Department of Education’s controversial borrower defense rule, Thompson Coburn partner Aaron Lacey is hosting a series of three upcoming webinars that will provide attendees with the latest information about the rulemaking process. 

The Borrower Defense Rule: 2017 Negotiated Rulemaking Debriefing Webinars will be held December 13, January 24 and February 21. 

Over the next three months, the Department of Education’s designated negotiators — including student and consumer advocates, agency representatives, accreditors, financial aid administrators, and business officers, as well as representatives from different types of institutions of higher education — will discuss key issues of the final rule, which, with few exceptions, will apply to all institutions of higher education.

Key topics include: 

  • How and when borrowers can seek to discharge their federal loans based on institutional misconduct.

  • How and when the Department can seek to recover discharged amounts from schools.

  • The possible revision of closed-school and false certification discharge provisions.
    The expansion of financial responsibility standards.

  • Updates to the institutional composite score calculation.

  • During each 90-minute webinar, Aaron will update postsecondary attorneys and compliance officers on the progress of the rulemaking and provide additional details regarding the key issues discussed during the most recent session.
