Law360 covered an August 10 panel at the American Bar Association’s (ABA) annual meeting in New York moderated by Steptoe New York partner Mike Miller and titled “The Yates Memo Turns Two – A Survey of its Impact on Corporate Cooperation.” The panel, which included perspectives from the prosecution, defense and forensic accounting side, agreed that after two years, the Yates Memo has probably had more impact on the companies being investigated than on the officials investigating them.
Steptoe partner Jason Weinstein, who participated in the panel discussion, remarked: "I think the memo has had more of an impact on company behavior than on [Department of Justice] behavior. The perception of the memo was more important than what the memo said."
