Former DOJ official Jeffrey Clark was almost the head of the Department of Justice, but now he’s battling with the D.C. Office of Disciplinary Counsel, this time with a third attempt to transfer the body’s investigation into his White House lawyering to the District of Columbia District Court.

“The [District of Columbia Court of Appeals] has no, or at best only limited authority to supervise the conduct of attorneys who conduct the business of the federal government and, like Congress itself, the DCCA has no authority whatsoever to discipline a federal counselor to the President based on Disciplinary Counsel’s own—or congressional—disagreement with the substance or development of advice and recommendations concerning Department of Justice law enforcement policy,” wrote Burnham and Gorokhov attorney Charles Burnham in the motion to transfer the case submitted to the D.C. federal court Thursday afternoon.
