Bard Hernia Mesh Plaintiff Seeks New Trial for Evidence Wrongs

C.R. Bard Inc. and Davol Inc. violated evidentiary orders in the first federal test trial over hernia mesh products, prejudicing the jury and denying plaintiff Steven Johns a fair trial, he said in a filing asking an Ohio federal court for a do-over.

Johns alleges Ventralight ST mesh products used in two hernia repair procedures caused abdominal adhesions—a type of scar tissue—that left him with chronic pain.

A jury in the U.S. District Court for the Southern District of Ohio rejected his product liability claims in September.
