GCs become more efficient as high risk class actions treble in three years

The proportion of class actions which is classified as 'high risk' or 'bet-the-company' has risen from 4.5 to 16.4% in three years but general counsel are rising to the challenge and managing them more efficiently, according to new research.

The research from 400-lawyer Carlton Fields Jorden Burt, in its fourth annual Class Action Survey, is based on 360 interviews with GCs. The 2015 research shows the 'dramaticaly intensified challenges' facing organisations, according to Chris S Coutroulis, co-chair of the firm's national class action practice.

Cutting costs

But, as the risk rises, general counsel appear to be responding. Mr Coutroulis said: 'The survey also provides ample data to confirm that companies are meeting those challenges head-on. Corporate counsel are increasingly adopting specific case strategies and expanding the use of proven tools and resources to manage risk effectively and minimize the impact on their businesses.' A growing number of businesses is increasing accountability, often putting one person in charge of this area. Those which use such a strategy spend an average of 12% less than rivals which do not, says the law firm. Source: Carlton Fields Jorden Burt
