Lauren Degnan Quoted in Law360 Article "Fed. Circ. Walks Back ITC Trademark Preclusion Ruling"

Fish trial attorney Lauren Degnan was recently quoted in a Law360 article discussing the Federal Circuit’s activity this week in taking back its circuit-splitting decisions that trademark rulings from the Internation Trade Commission preclude district court litigation over the same issue.

Fish & Richardson PC principal Lauren A. Degnan, who has been following the case, said while the Federal Circuit may have undid its circuit-splitting decision, it didn't analyze the issue further or adopt the rulings of other courts. Instead, she said, it backed off the question entirely, leaving its position uncertain.

"People can read the tea leaves, but by vacating their analysis and staying silent, [the Federal Circuit] eliminated the circuit split but leaves the issue for another day," she said.
