Shareholder Edward Gross played a key part in the drafting of the newly passed FAA Reauthorization Act of 2018.

The bill, passed by the Senate on October 3, 2018 and signed into law on October 5, 2018, reauthorizes the Federal Aviation Administration (FAA) programs and funds the program through 2023, the longest such authorization since 1982. Mr. Gross played an instrumental role in the changes to 49 U.S.C. § 44112, outlined in Section 514 of the bill. The edits to § 44112, a safe harbor provision for aircraft lenders and lessors, aim to clarify judicial interpretation of the statute. The bill was sponsored by Rep. Brett Guthrie of Kentucky and was the first FAA funding bill since 2012. It is also notable for a variety of safety and security improvements for airline passengers and changes to the regulation of small unmanned aircraft systems (UAS or drone) operations.

Mr. Gross’s Equipment Leasing and Finance Association (ELFA) colleague, Richard Shanahan of Hitachi, was also a valuable contributor, as was Darby Becker from GE Corporate and Jonathan Rauch, a law clerk (pending bar admission) in Vedder’s DC office. The new safe harbor provisions will have noticeable impact on future liability claims.
