ALBANY, NY (WRGB) Attorney General Eric T. Schneiderman says they have filed suit against a photography studio, accused of not delivering photos to hundreds of consumers.

The Ag's Office says that charges were filed against GND Studios, LLC, a photography studio operating as Big League Pics, and its owner, Robert Dungan.

The lawsuit accuses Dungan of photographing the leagues’ teams and individual players in May 2017 while under contract with the Niskayuna Baseball League and the Niskayuna Softball League, collecting thousands of dollars from parents for a variety of photography packages ranging in price from approximately $18 to $49.

“New Yorkers spent their hard-earned money to have a keepsake of their children’s baseball and softball experiences. Parents were right to cry foul when Big League Pics allegedly didn’t deliver – and my office will seek to hold the company responsible for depriving parents of both their dollars and their memories,” said Attorney General Schneiderman.

Schneiderman's office says that court papers state that Dungan, urged to deliver refunds or deliver the photos, failed to do so.

Consumers who have a complaint against Dungan or GND Studios are urged to file a complaint online or call 1-800-771-7755.

CBS6 reached out to Robert Dungan who sent a statement saying that he is a small business who "got in over our heads when we lost our vendor"

Dungan says that those that used credit cards have already been given refunds.

He also told CBS6 that he is already working with another vendor to complete outstanding orders.
